New York State passed a new Paid Sick Leave Law with accruals beginning on September 30th, 2020, and benefits payable January 1, 2021.  There is a lot of confusion around this law due to the COVID rules, and the PFL enhancement. This law is different and is separate from the other paid sick leave benefit. How much of a benefit you provide is based on an employer’s size.

-4 or fewer employees and less than $1 million in net income requires employers to provide up to 40 hours of unpaid sick leave in a calendar year

-4 or fewer employees and more than $1 million in net income requires employers to provide up to 40 hours of paid sick leave in a calendar year

-5-99 employees requires employers to provide up to 40 hours of paid sick leave in a calendar year (regardless of income)

-100+ employees requires employers to provide up to 56 hours of paid sick leave in a calendar year (regardless of income)

***Please note that this is not in addition to your existing benefits. It is simply the minimum benefit that you must provide.
